Terms of Service Solwayt
These Terms of Service ("Terms", "ToS") govern access to and use of the Solwayt service, provided by Niabyte ("we", "us", "our", "Solwayt").
By accessing or using Solwayt, you confirm that you have read, understood, and agreed to these Terms.
If you do not agree with these Terms, you must not use the Service.
1. Service Description
Solwayt is an AI-powered video analysis tool that provides automated analysis, insights, and supporting information based on content uploaded by users.
Solwayt does not provide legal, financial, medical, marketing, or any other professional advice and does not guarantee the accuracy, completeness, or suitability of analysis results for any specific purpose.
2. Governing Law and Jurisdiction
These Terms are governed by and interpreted in accordance with the laws of Ukraine.
Solwayt also seeks to comply with applicable standards and regulations of other jurisdictions, including the European Union and the United States, to the extent they apply to specific users, without creating an obligation that Solwayt is a legal entity or resident of those jurisdictions.
3. Eligibility and Use of the Service
Solwayt is available to:
- individual users;
- business users and legal entities.
Commercial use of the Service is permitted.
The minimum age to use Solwayt is 13 years.
Users under the age of 18 confirm that they have obtained consent from a parent or legal guardian.
4. Accounts and Access
4.1 Account Registration
Access to Solwayt requires the creation of an account.
Registration may be completed via:
- email and password;
- third-party authentication methods (OAuth).
Users agree to provide accurate and up-to-date information.
4.2 One Account per Person
Each account is intended for use by one individual only.
Account sharing, transfer of access, or any attempt to bypass this restriction is considered abuse of the Service.
4.3 Suspension and Termination
Solwayt may suspend or restrict access to an account if a user:
- violates these Terms;
- abuses the Service;
- attempts to bypass technical or pricing limitations.
Users have the right to request an explanation for any restriction or suspension.

5. Nature of the Service and Disclaimer of Warranties
Solwayt is provided on an "as is" and "as available" basis.
Solwayt does not guarantee:
- the accuracy, relevance, or usefulness of analysis results;
- the achievement of any specific outcomes;
- uninterrupted or error-free operation of the Service.
The only guarantee provided is the actual availability of the Service in accordance with the selected plan.
6. Limitation of Liability
Solwayt shall not be liable for any direct or indirect damages, loss of profits, loss of business opportunities, reputational damage, or other losses arising from the use or inability to use the Service or its results.
Any decisions made based on Solwayt's analysis are made entirely at the user's own risk.
7. Payments, Subscriptions, and Credits
7.1 Subscriptions
Solwayt may offer paid subscription plans which:
- are billed on a monthly basis;
- renew automatically unless cancelled by the user.
Users may cancel their subscription at any time through their account settings.
7.2 Credits
Credits are provided according to the selected credit packages.
Unused credits remain available on the user's balance.
In the event of a refund, the corresponding credits are voided.
A negative balance may occur only if credits were partially used prior to a refund request.
8. Refunds and Compensation
Solwayt may issue compensation only within the scope of the Service, including cases where:
- a technical failure on Solwayt's side occurred;
- credits were deducted without providing analysis results.
All refund requests are reviewed after contacting support@solwayt.com and providing relevant evidence.
9. User Content
9.1 Ownership
Users retain full ownership of all uploaded content.
Content may be:
- temporarily stored as required to operate the Service;
- deleted by the user at any time.
Analysis context and generated outputs may be stored separately.
9.2 License for Processing
By uploading content, users grant Solwayt a limited, non-exclusive license to process such content solely for the purpose of providing the Service.
9.3 Use for Service Improvement
Solwayt may change its approach to using content for service improvement only with explicit user consent, obtained through a separate confirmation mechanism.
10. Prohibited Content
Users must not upload content that:
- is illegal or unlawful;
- infringes the rights of third parties;
- contains personal data without lawful grounds;
- violates applicable rules, standards, or ethical norms.
Full responsibility for uploaded content rests solely with the user.
11. Service Availability and Force Majeure
Solwayt may become temporarily unavailable due to technical maintenance or circumstances beyond reasonable control.
Solwayt is not liable for failure or delay in performance caused by force majeure events, including but not limited to outages, infrastructure failures, or external restrictions.
